The judicial courts of Mozambique’s provinces will from next year have conflict mediators to make justice faster and more accessible, the press reported yesterday.
The dynamics of social and economic life, as well as the increase in cases presented by citizens to judicial bodies, have dictated the need to introduce mechanisms to make justice faster and more accessible, a Supreme Court source said.
The introduction of the mediator aims at resolving cases that do not need to be judged.
The mediator will resolve conflicts of civil and commercial nature, if they include available rights.
The mediation can solve part of the conflict or all, obeying the will of each one of the parties, which means that it is not obligatory, said the same source.
An impartial third party independent and non-decision-making person shall be designated to find solutions between the parties to the dispute.
The professional judge will ensure the coordination of the activities, operation and training of mediators.
The mediation ends with consensus or when one of the parties informs the mediator that it is not possible to reach an agreement, it will then get to the judicial phase.
Mediation is free and parties to litigation may be accompanied by a lawyer, the newspaper added.
