Mozambique: Attorney general hearing Venancio Mondlane over protests, unrest

Mozambique’s president, Filipe Nyusi, on Tuesday enacted a law establishing the special legal regime for the extended loss of property and recovery of assets, said a statement by the presidency.
The law, approved by parliament by consensus on 11 November, resulted from a proposal presented on 5 November by the Mozambican government, through the minister for justice, constitutional and religious affairs, Helena Kida.
The document, approved by the cabinet meeting in July, provides for the confiscation of assets related to illicit activities, including assets that were in the accused’s sphere five years before the indictment.
The rule also requires justice to pursue property in the possession of a third party, which has been disposed of free or against payment by the defendant up to five years before the charge.
On the other hand, assets that are not compatible with the lawful income of the person convicted of criminal activity will be presumed to be illicit and subject to state appropriation.
The law also provides for the government to establish an Asset Recovery Office and a Goods Administration Office.
The document requires the breach of professional secrecy on matters of interest for the discovery of the material truth of facts related to criminal activity by members of the governing bodies of credit institutions, financial companies and tax administration officials.
