The former President of the Bar Association, Gilberto Correia, said yesterday in the city of Beira that the lack of political will to carry out necessary and profound reforms in the country is dragging Mozambicans into collective chaos, given the absence of a true rule of law, which is leading the country to experience dangerous times and profound uncertainty.
Gilberto Correia, who spoke at the inaugural lecture at Licungo University, began by recalling that the idea of separation of powers, as a fundamental assumption that today is called the Rule of Law, was addressed in a consolidated and systematized way by Montesquieu, in one of his works, published in 1748, namely, legislative power, executive power and judiciary power.
Montesquieu recommends in his work that these powers be independent, hold balanced powers and have mechanisms of reciprocal control.
The second biggest challenge pointed by Gilberto Correia is the depoliticization of the State. The partisanship of the State, continued Correia, who addressed some of the challenges of the democratic rule of law in Mozambique, favors the radicalization of the political environment.
Correia added that post-election violence, based on accusations of electoral fraud, is increasing, becoming cyclical, territorially more widespread and more destructive.
The Rector of UniLicungo, addressing the students and based on Gilberto Correia’s intervention, pointed to them as the hope for the future.
