The Podemos party says that the Constitutional Council (CC) cannot move forward to validating the election phase without considering the appeal filed by the party. Furthermore, the CC must first consider the issues it has presented, and then decide whether or not the CNE’s decision can move forward. Podemos leader Dinis Tivane says that “electoral truth” must be reinstated.
Tivane was speaking to the press on Saturday about the CC’s claim that Podemos did not file an appeal in relation to the presidential elections.
“Indeed, the way our appeal is written may tend to give this impression, but it follows that, for legal reasons, we are responding to CNE’s decision 105 and the title of this decision is related to the holding of all elections. Therefore, the presidential, legislative and provincial elections are more than enough reasons for us to understand that the claim that Podemos failed to appeal in relation to some elections cannot be upheld,” Tivane explained.
Tivane said there was a tendency for the Constitutional Council to implement the law as it sees fit.
“To reject the CAD, it could reject the CAD by invoking facts that occurred at a previous time, therefore, at a time that had already been consolidated as a given. And now, when it comes to rejecting the [Mozambican] elections [held] in Zimbabwe, it says that it is no longer possible because it is untimely,” Tivane said.
Tivena, the Podemos electoral representative [‘mandatário’] insisted that the electoral truth must be restored.
“What we demand is the electoral truth. (…) The public out there often gets confused, thinking that ‘electoral truth’ means declaring Venâncio Mondlane the winner. But that is not it. Let’s understand one thing: we live in a democratic state of law, which means that the institutions and the matters that these institutions deal with must comply with what the legal institute recommends. The election is a sui generis legal process. So, when we speak of electoral truth, we must follow all the procedures and all the legally imposed steps,” Tivane said.
