Mozambique criminalises unauthorised access to mobile phone, tablet or computer, to be punished with imprisonment

The Penal Code has been revised by the Assembly of the Republic, by consensus, to punish with prison anyone who accesses, without the permission of the owner “a device belonging to another, fixed or mobile, connected or not to the computer network, in order to obtain non-public information in either mail or private electronic communications.”

The revision, which aims to adapt criminal law to the realities of modern communication technologies, now states that anyone who, “without legal permission or without being authorised by the owner, another holder of the right to the system or part of it, invades a device belonging to another, fixed or mobile, whether or not connected to the computer network, for the purpose of obtaining non-public either mail or private electronic information, private data access, business or industrial secrecy, confidential information or unauthorised remote access of the device, is punished by imprisonment of 1 to 2 years in prison and a fine of up to 1 year [minimum salary].”

However, the penalty is of one to five years imprisonment for those”who illegitimately produce, sell, distribute or in any other way disseminate or introduce in one or more computer systems a device, program, executable set, code or other computer data intended to produce the unauthorised actions described in the previous paragraph,” according to paragraph number 2 of Article 246 of the Penal Code revised by the Assembly of the Republic shortly before closing the ordinary sessions of the VIII Legislature.
