Passengers responsible for exceeding the capacity determined for passenger transport vehicles will be liable to a fine, under Decree 35/2019, which will come into force in August. “It is necessary to impress on passengers what it means to board a vehicle which is already full,” National Director of Transport and Security of the Ministry of Transport and Communications Cláudio Zunguze told @Verdade.
“In urban transport, fines for excess capacity are levied on the passenger in the amount of the cost of a ticket on the route for which the vehicle is licensed, and the passenger is required to disembark,” paragraph 4 of article 106 of the new Regulation of Transport in Automotive Vehicles determines.
Interviewed by @Verdade, Zunguze explained: “Here, we intend to bring in a third figure to help. Sometimes the exceeding of capacity is due to the request of the passenger himself, although this does not exempt the responsibility of the driver and /or the operator. Here, it is necessary to make a conjugation between the Traffic Code, which already provides for situations of over-filled vehicles, in a way which does not exempt the operator, and paragraph number 4 of Article 106, so that transport operation is in conformity.
“It is necessary to bring this awareness and responsibility of the passenger on what it means to board a vehicle that is already full, this will also wake up other users to the fact that the last passenger to board, exceeding the capacity, has to be held accountable.”
The article, on the ‘Lotação’ website, further defines that: “In inter-provincial and international cariers, the passenger has the right to a seat duly marked”. “In urban roads, the number of standing passengers allowed will be indicated on the inspection form, observing the compatible conditions of the vehicle and the safety of users.” Paragraph number 3 sates: “For each passenger in excess, the operator is punished with a fine corresponding to the cost of the ticket on the longest route for which the vehicle is licensed.”
