Five of 19 defendants in the hidden debts case were released on Sunday on surety of identity and residence. Crimildo Manjate, Naimo Quimbine, Mbanda Henning, Sidónio Sitoe and Simione Mahumana will now await trial in freedom, thanks to the judges of the Criminal Section of the Supreme Court.
In a ruling dated March 9th on case 160/2020, the judges explain that the provisional freedom granted to the five defendants is on terms of identity and residence, each bound to appear before the court every Monday at 9:00 a.m.. They must not change their residence or be absent for more than five days without court authorisation, nor can they communicate with the other defendants in the process by any means, direct or indirect.
They are also prohibited from leaving the country without prior authorisation from the court, their passports or other travel documents being subject to police surveillance and to being surrendered.
Six other defendants will be released from prison on a date not yet specified, subject both to the measures described above and, additionally, bail.
These are Fabião Mabunda, who is expected to pay 10.1 million meticais, Manuel Renato Matusse (6.1 million), Maria Inês Moiane (3 million), Khessaujee Pulchand (1.2 million), Sérgio Namburete (522,000 meticais) and Zulficar Ali Esmail Ahmad (309,000).
‘Notícias’ learned from the Supreme Court that all 19 co-defendants were notified of the ruling, including the defendants who have not been granted release from pre-trial imprisonment, namely Bruno Langa, Ndambi Guebuza, Gregório Leão, ngela Leão, Cipriano Mutota, Teófilo Nhangumele and António do Rosário.
Once in possession of the case, it is up to the Judicial Court of the City of Maputo to set the date for the start of the trial.
The ruling by the justices of the criminal section of the Supreme Court results from the appeal submitted by the co-defendants in the hidden debts case against the order issued by the Superior Court of Appeal, which maintained the original indictment of the Judicial Court of the City of Maputo.
