The Mozambican Supreme Court [Tribunal Supremo] will have to rule within days on the appeal submitted by the co-defendants in the case of the hidden debts against the ruling issued by the Superior Court of Appeal [Tribunal Superior de Recurso], which maintained the indictment ruling issued by the Judicial Court of the City of Maputo (TJCM).
According to what “Notícias” understands, the date for the issuing of this ruling is not yet known, but the Supreme Court is already working on the matter, after some of the 19 defendants disagreed with the indictment ruling and submitted a second appeal. Only after analysing it will it be possible to know the defendants’ future, namely, whether or not they are going to trial.
In the 5 June ruling, the High Court of Appeal upheld the indictment ruling handed down by the Judicial Court of the City of Maputo, dismissing the appeals filed by the co-defendants against the indictment ruling handed by the court of first instance, in case 18/2019-C. This time, the coercive measures applied to all of them were maintained, with the exception of Márcia Amélia Biosse de Caifaz Namburede, whose indictment was withdrawn because there were doubts about her participation in the crimes she was accused of, and her immediate release ordered.
The co-defendants are accused of crimes including association to commit crimes, blackmail, passive corruption, embezzlement, abuse of position or function, violation of management rules, forgery of documents, use of false documents, possession of forbidden weapons and money laundering, with modifications resulting from the evidence collected.
The co-defendants in the case awaiting trial in prison are: Manuel Renato Matusse, Sidónio Sitoe, Crimildo Manjate, Mbanda Buque Henning, Khessaujee Pulchand, Simione Mahumane, Naimo Quimbine, Márcia Caifaz Namburete,Zulficar Ahmad, Teófilo Nhangumele, Bruno Tandane, Cipriano Mutota, Armando Ndambi Guebuza, Gregório Leão, António Carlos do Rosário, ngela Buque Leão, Maria Inês Moiane Dove and Fabião Mabunda e Sérgio Namburete.
Elias Moiane, nephew of Inês Moiane’s nephew, remains on provisional release after having paid a bail of one million meticais.
The undeclared state-guaranteed debts were incurred by the companies Proíndicus, Ematum and MAM.
