Guinea-Bissau’s Court of Appeal has deemed as “null” and of “no effect” the travel ban order imposed on the president of the African Party for the Independence of Guinea and Cabo Verde (PAIGC), Domingos Simões Pereira.
“We have just been notified of the decision taken on the incident we had placed before the Court of Appeal regarding the incompetence of the public prosecutor and the attorney general to take that decision and the Court of Appeal has just confirmed that we were right,” Carlos Pinto Pereira, coordinator of the collective of lawyers of Domingos Simões Pereira, told Lusa.
According to the lawyer, the decision of the attorney-general was considered by the Court of Appeal as “illegal and consequently declared it null and void”.
“At this moment, the travel ban applied to Domingos Simões Pereira has no effect. Therefore, we expect him to be able to travel freely whenever he wishes,” the lawyer said.
The deputy, who has never been stripped of his parliamentary immunity, leader of the PAIGC was prevented from leaving the country three weeks ago at the Osvaldo Vieira international airport in Bissau as he was preparing to travel to Lisbon.
The travel ban was justified by the emigration services with “orders from above”.
A document from the Attorney General’s Office, sent to the Ministry of Interior, to which Lusa had access, ordered the “embargo of travel of Domingos Simões Pereira” for having been declared “suspect” and for “fear of flight from justice.
