The hearing of the former finance minister began at around 11.40 a.m. this Monday and did not last for 30 minutes.
The case has been postponed until Monday, March 18, because Manuel Chang’s legal defence has submitted an application to the South African State requesting that Justice Minister [Michael Masutha] decides which of the two pending extradition requests will be the first to be analysed.
The lawyers invoked Article 15 of the South Africa-United States Extradition Agreement and Article 11 of the SADC extradition protocol to justify that Judge William Schutte has no jurisdiction to decide on which of the extradition requests will be the first examined and argue that the decision must be taken by the Justice Minister.
Therefore, they want the executive to determine whether the requests from Mozambique and the United States will be the first to be heard by the Court.
The Minister’s decision is due on Wednesday, 13 March. The hearing set for 18 March is expected to be continued on 19 March.
It is recalled that, last Thursday, the judge had ruled that the request for extradition from the United States would be the first to be examined.
