The Attorney General’s Office (PGR) is finalising the draft bill on asset recovery and the management of confiscated assets, and deciding upon the institutions that will implement the law, under the terms of the United Nations Convention against Corruption, Notícias reports.
PGR spokesperson Bernardo Duce said the legislation and respective institutions would establish the mechanisms for identifying, locating and seizing assets, products or advantages related to crimes, both domestically and internationally.
The bill has already been submitted to the Ministry of Justice, Constitutional and Religious Affairs, now awaiting the decision of the government, before being referred to the Assembly of the Republic.
“Crime cannot be allowed to be a source of enrichment, and the law seeks to attribute the power to recover all benefits resulting from or achieved through unlawful acts, either to compensate the victims, to compensate the state, or nullify the favours of crime,” he explained.
For the PGR, depriving criminals of the fruits of their activity can be as effective as restricting their freedom. Asset recovery can include vehicles, cash, homes, and other assets that are typically accumulated by transgressors.
“We therefore emphasise the importance of establishing an institution for the recovery of assets acquired through criminal conduct, as recommended by the United Nations Convention Against Corruption,” Duce said.
Attorney General Beatriz Buchili is currently visiting Sofala, where she is evaluating the performance of PGR subordinate organs and other public institutions involved in combating and preventing corruption.
