Maputo city’s Attorney’s Office has reacted to Traffic Police fining the drivers of vehicles with tinted windows, saying it finds no legislation in force that limits the use of tinted glass in vehicles and considers it illegal to prohibit or punish it.
According to the prosecutor’s office, the police’s actions are not covered by law, article 118 of the Road Code, invoked by the police to prohibit the use of tinted glass and stating that “it is considered a vehicular transformation, any change in its constructive or functional characteristics …” and, “Only those changes which modify the constructive or functional characteristics of the vehicle, that is, those that imply a change in the functionality of the systems and which have a direct impact in its operation” in its view not providing material grounds for objecting to tinted glass.
The Attorney’s Office consequently appeals to the police to comply with the law, and abstain from such practices in future.
