O País / INATTER says the Municipal Police can supervise driving licenses and insurance

The institution that regulates land transport in Mozambique has issued a clarification regarding the competencies of the transit authorities, including the Municipal Police and citing article 10 of the Road Code.

“Perhaps the way we look at article 10 may be different, but it lists the institutions that have competencies to conduct inspections. Not only [does it list] the municipal councils, but it also indicates the National Roads Administration (ANE) and the Police of the Republic of Mozambique (PRM). It does not bring to each institution its operative arm. These are provisions of the Road Code,” the spokesman of the National Institute of Land Transport (INATTER) argued in defence of municipal authorities’ competence to intervene in all aspects of road transport including parking, the inspection of driving licenses and vehicles insurance, traffic taxes and other matters.

Article 10 of the Road Code states in paragraph number 1 that “the supervision of compliance with the provisions of this Code and other legislation on transit is assigned, without prejudice to other specially competent entities, to the Traffic Police, the National Traffic Institute, and the National Roads Administration on national roads and to municipalities on municipal roads, streets and paths”.

Municipal Police began to oversee all traffic rules in the Municipality of Maputo, including inspection of driving licenses and vehicles insurance, on July 31, but the decision has met opposition.

The MDM in the Maputo Municipal Assembly suggests that the decision should have been discussed prior to implementation, while lawyer Elísio de Sousa says that municipal authorities do have the authority to inspect vehicles, but warns that the confusion generated may be the result of weaknesses in the law, and therefore proposes reviewing the legislation.
