Revision of the law facilitates disposal of state property in Mozambique – Government

The procedures for the sale of real estate under management of the State Property Administration (APIE) will be made more flexible with the amendment of the Leasing Law, whose revision proposal was approved yesterday by the Government.

The revision, which is still to be submitted to the Assembly of the Republic, is intended to ensure that greater accountability of tenants in state properties.

The Deputy Minister of Health and spokesman for yesterday’s session of the Council of Ministers, Mouzinho Saide, explained that the amendment would reinforce duties both on the part of the state and the part of tenants, in order to ensure that they honour commitments.

“There are some duties that are reinforced. For example, those who do not pay rent to the APIE may be sanctioned for the fact, and if they are repeat offenders, there may be a termination of the contract. There may also be other types of penalties if the property is not used for the purpose for which it was intended. In the case of commercial activity, the rules overseeing the purpose for which the property was rented must also be obeyed,” Saide said.

“This proposal aims to adapt the law to the current social, political and economic dynamics of the country, to conform it to the constitutional imperatives, to remove inconsistencies that have put the law in conflict with other legal provisions and to reform the process of alienation of state property.”
