The government this Tuesday (22-11) approved proposals for a law legalizing the functioning of the ‘Local Force’, units of which have for a long time been operating in a legal void, an issue which has been dividing public opinion since the matter hit the spotlight at the beginning of this year.
According to the spokesperson for the 40th Ordinary Session of the Council of Ministers, Filimão Suaze, the now-approved proposal aims to add Article 7A to Law No. NLaw No. 18/2019, of September 24, Law on National Defense and of the Armed Defense Forces of Mozambique.
“This amendment aims to attribute competence to the Council of Ministers to approve the norms for the creation, organisation and operation of the Local Force, made up of members of the community of a basic territorial circumscription, which operates under the Chief of the General Staff of the Armed Forces of Defence of Mozambique,” Suaze explained.
The claim to legalize the Local Force comes at a time when this group, made up mainly of former combatants, has been operating against terrorism in Cabo Delgado for a long time. It is not known exactly when it began to operate. No public official announced the start of operations, in contrast with what happened with the Rwandan and SADC forces.
The Local Force became widely known after Soico Television reported on it, questioning the legality of its existence and operations. This force, armed with war material, fights terrorism alongside the FDS and foreign forces, but its existence and operations are not provided for by law, namely in the aforementioned Law on National Defence and Armed Forces for the Defence of Mozambique.
The legality or illegality of the Local Force created debate when it was triggered, with pros and cons. Some were in favour, because the defence of the homeland was a paramount matter. In this context, they advocated for its operations and, later, its legalisation.
However, other analysts questioned, for example, the illegal possession of weapons of war attributed to this group, a fact that violates paragraph a) of article 6 of Decree 8/2007, on Regulation of Weapons and Ammunition, which limits the use of this type of war material to the SDF.
What is the Local Force?
Due to the absence of a legal framework , there is no properly elaborated concept on the Local Force. However, based on what the press reports, the Local Force is a ‘military’ group(s) recognized by the state, with uniforms and war material, made up of, in addition to former combatants, young people and volunteers, some without training or experience, who operate to prevent attacks in districts affected by the terrorism.
Like the FDS and foreign forces, the Local Force carries out surveillance and the dismantling and pursuit of terrorist acts. Although made up of various social strata, the Local Force is largely based on the National Liberation Struggle Combatants Association (ACLLN).
Class operations may have started after the ACLLIN requested arms approximately three years ago, to protect communities in the face of an apparent inability of the FDS to combat terrorism at that time.
