Mozambique: Lawyer under investigation for money laundering and obstruction of justice – Noticias report

Lawyer Alexandre Chivale is being investigated by the Public Prosecutor’s Office, in an autonomous proceeding, on suspicion of money laundering in the companies Txopela Investimentos and Dandula, of which he is a director and majority shareholder, respectively.
According to Notícias sources, the investigations arose after evidence of the lawyer’s connection with the two companies, allegedly used to receive money from Privinvest for the benefit of private individuals, came to light.
The same Noticias sources state that the investigations were also spurred on by the fact that the lawyer was suspected of obstructing proceedings currently being carried out by the Public Prosecutor’s Office.
Chivale is also indicated as regularly travelling to Lebanon to meet Jean Boustani and other Privinvest partners, a fact which, according to the Public Prosecutor, is making the normal course of investigations unfeasible.

Until recently the defence lawyer of ‘hidden debts’ trial defendants António Carlos do Rosário, Maria Inês Moiane and Elias Moiane, Chivale was prevented by the court from continuing to represent them on the grounds of incompatibility and conflict of interests, and ending up being appointed a declarant in the case.
The Public Prosecutor’s Office alleges, in the indictment of the ‘hidden debts’ case, that Txopela Investimentos, the company of which the lawyer is administrator, received, concealed and laundered millions of dollars paid by the Privinvest Group for the purchase of properties in favour of defendant António Carlos do Rosário.
The Public Prosecutor also indicates that Chivale holds 75 percent of the capital as a partner in the company Dandula, which manages the real estate assets acquired by Txopela Investimentos with the funds resulting from the default which is currently being tried.
Last week, judge Efigênio Baptista ordered the dismissal of Txopela Investimentos as a trustee for not having been appointed by the court in the order that determined the seizure of the properties occupied and managed by the lawyer.

As a result, the judge of the case ordered the administrator of Txopela, in this case the lawyer Alexandre Chivale, to abandon, within five working days, the aforementioned real estate assets and hand over the keys to the court, which, in turn, will deposit them with the Administration of State Properties (APIE).
On Thursday of last week, Alexandre Chivale was replaced in the present case by Isálcio Mahanjane, who will now defend, in addition to Ndambi Guebuza, co-defendants António Carlos do Rosário, Maria Inês Moiane and Elias Moiane.
Mahanjane asked for five days to better study the case in matters dealing with his three new constituents, so the court suspended the trial until the 28th of this month.
Chivale will now have to appear in court as a declarant in the case currently under trial.

Chivale sob investigação de branqueamento de capitais e obstrução à justiça
O advogado Alexandre Chivale está a ser investigado pelo Ministério Público, num processo autónomo por suspeita de branqueamento de capitais nas empresas Txopela Investimentos e Dandula, nas quais é administrador e sócio maioritário, respectivamente.
Segundo fontes do Notícias, as investigações surgiram após evidências da ligação do causídico com as duas empresas, usadas para receber dinheiro da Privinvest em benefício de particulares. As mesmas fontes referem que as investigações foram igualmente espevitadas pelo facto de o advogado estar a ser suspeito de obstruir a continuidade das diligências em curso por parte do Ministério Público.
Chivale é também apontado de, sistematicamente, viajar para o Líbano ao encontro de Jean Boustani e outros sócios da Privinvest, facto que, segundo o Ministério Público, está a inviabilizar o curso normal das investigações sobre estes.
Até há bem pouco tempo advogado de defesa dos réus António Carlos do Rosário, Maria Inês Moiane e Elias Moiane no julgamento do caso “Dívidas Não Declaradas”, Alexandre Chivale, viu-se impedido pelo tribunal de continuar a exercer o patrocínio dos mesmos por incompatibilidade e conflito de interesses, acabando por ser constituído declarante nos presentes autos.
O Ministério Público refere, na acusação do caso “Dívidas Não Declaradas”, que a Txopela Investimentos, empresa de que o causídico é administrador, recebeu, dissimulou e branqueou milhões de dólares pagos pelo Grupo Privinvest para a compra de imóveis a favor do réu António Carlos do Rosário.
Aponta ainda Chivale de deter 75 por cento do capital como sócio da empresa Dandula, que gere os activos imobiliários adquiridos pela Txopela Investimentos com os fundos resultantes do calote, ora em julgamento.
Na semana passada, o juiz Efigênio Baptista ordenou a exoneração da Txopela Investimentos como fiel depositária por não ter sido nomeada pelo tribunal, no despacho que determinou a penhora dos imóveis ocupados e geridos pelo causídico.
Em consequência, o juiz da causa ordenou ao administrador da Txopela, neste caso o advogado Alexandre Chivale, a abandonar, em cinco dias úteis, os referidos activos imobiliários e entregar as chaves ao tribunal que, por sua vez, os depositará na Direcção Nacional do Património do Estado.
Na quinta-feira da semana passada, foi substituído nos presentes autos pelo advogado Isálcio Mahanjane, que passa doravante a defender, para além de Ndambi Guebuza, os co-réus António Carlos do Rosário, Maria Inês Moiane e Elias Moiane.
Mahanjane pediu cinco dias para melhor estudar o processo nas matérias que versam sobre os seus três novos constituintes, tendo por isso o tribunal interrompido o julgamento até ao próximo dia 28.
Recorde-se que o advogado Chivale deverá se apresentar no tribunal como declarante, no caso ora em julgamento.
