The Judicial Court of Nampula on Monday (14-06) sentenced defendant Nordino Abdul Tacamal to the maximum possible term of 19 years and 6 months in prison for raping two minors, aged 8 and 10.
The 30-year-old defendant, taking advantage of the absence of their parents, raped both child on a promise of 50 meticais.
The panel of judges of the 6th Section of the Judicial Court of Nampula Province, in northern Mozambique, decided on the maximum sentence, having considered proved his moral and material authorship of the crime of rape of a minor under twelve years of age.
The crime took place in Nampula’s Muahivire neighbourhood on 29 December of last year.
Tacamal was also ordered to compensate the minors’ family in the amount of 40,000.00 meticais.
Dr. Cristina Miguel, Judge of the case, said, in the reading of the sentence, that “on December 29, 2020, around 11:00 a.m., the defendant would have met the minors while they were playing in an abandoned mill on Rua Sem Exit”, and that moments later as one of the victims went to the toilet, the man raped the other child by anal penetration, and on the return of the other he would have negotiated the payment of 50,00 meticais (fifty meticais), not only to pay for silence, as well as to rape the other minor.
“The defendant, at no time, showed signs of repentance. The facts, described in this way, took place because the defendant acted with manifest contempt regarding the age of his victims”, understands the judge.
The Public Prosecutor’s Office (PGR) representative Cristóvão Mulieca, was the satisfied with the decision taken by the court, understanding that it was within the expectations of the organ.
According to this source, the PGR has been involved in prosecuting cases of this nature, demanding the application of the maximum penalty in order to discourage such practices.
“In relation to the sentence handed down, this is what we had already expected”, said Dr. Mulieca, continuing that “in a computation, at the moment, the Public Prosecutor’s Office is more concerned with the psychosocial monitoring of the two minors, and we are already doing the follow-up”.
