Mozambique’s Attorney of the Republic (PGR) indicates that there are manoeuvres underway aimed at perverting the justness and legitimacy of the State’s claims in the London Court, Noticias reports today.
Such manoeuvres are led t by the Privinvest Group, within the scope of contracts for the supply and, or provision of services, entered into with each of the three companies, namely ProÍndicus, Ematum and MAM.
With their more visible face translated into claims (through courts and arbitration tribunals,)against the State. the PGR refers that the arbitration claims, all initiated by the Privinvest Group, were brought against the State, in its capacity as guarantor, and against those [three] companies.
The lawsuits were filed by VTB Capital, BCP and VR Capital.
In February 2019, the Attorney General’s Office, representing and defending the interests of the Mozambican State, filed in London a civil suit against 12 defendants, namely Credit Suisse International, Credit Suisse AG, Surjan Singh, Andrew James Pearse, Detelina Subveva, Privinvest Shipbuilding SAL (Holding), Abu Dhabi Mar Investments LLC, Privinvest Shipbuilding Investments LLC, Logistics International SAL (Offshore), Logistics International Investments LLC, Credit Suisse Securities (Europe) Limited, and Iskandar Safa, because the PGR believes that they played a key role in the orchestration of the project that resulted in the ‘hidden debts’ scandal.
In the above mentioned lawsuit, the PGR requests, on behalf of the State, the declaration of invalidity, illegality and unenforceability of the guarantee, allegedly issued by the government, in the scope of loans to the company Proindicus.

It also asks for reparation – in the most diverse legal aspects, to be provided by all defendants – for the damages caused to the State, due to the issuance of the said guarantee.
DÍVIDAS NÃO DECLARADAS: PGR denuncia manobras para perverter a justeza
A Procuradoria Geral da República (PGR) aponta haver manobras visando perverter a justeza e legitimidade das reivindicações do Estado no Tribunal de Londres, protagonizadas pelo Grupo Privinvest, no âmbito dos contratos de fornecimento e/ou prestação de serviços, celebrados com cada uma das três empresas, nomeadamente a ProÍndicus, Ematum e MAM.
Com face mais visível, traduzida em acções (judiciais e arbitrais) contra o Estado, a PGR refere que as acções de arbitragem, todas desencadeadas pelo Grupo Privinvest, foram intentadas contra o Estado, na sua qualidade de garante e contra aquelas empresas.
As acções judiciais são da autoria do VTB Capital, do BCP e do VR Capital.
Em Fevereiro de 2019, a PGR intentou, em Londres, em representação e defesa dos interesses do Estado moçambicano, uma Acção Cível contra 12 réus, nomeadamente Credit Suisse International, Credit Suisse AG, Surjan Singh, Andrew James Pearse, Detelina Subveva, Privinvest Shipbuilding SAL (Holding), Abu Dhabi Mar Investments LLC, Privinvest Shipbuilding Investments LLC, Logistics International SAL (Offshore), Logistics International Investments LLC, Credit Suisse Securities (Europe) Limited, e Iskandar Safa, por acreditar terem tido papel chave na orquestração do projecto que resultou no escândalo das dívidas ocultas.
Na referida acção, a PGR pede, em nome do Estado, a declaração da invalidade, ilegalidade e inexequibilidade da garantia, alegadamente emitida pelo Governo, no âmbito dos empréstimos à empresa ProÍndicus.
Pede ainda uma reparação, nas mais diversas vertentes legais, a ser prestada por todos os réus, pelos danos causados ao Estado, em virtude da emissão da referida garantia.
