‘Undeclared debts’: Defendants appeal judge’s dispatch authorising trial

Defendants in the so-called ‘hidden debts’ case have appealed against the ruling issued last week by the Maputo City Court, when the judge of the 6th Chamber of the court issued a dispatch authorising trial following the definitive indictment by the Public Prosecution Service, Mozambican daily ‘Notícias’ reports today.

‘Notícias’ has established that the appeals lodged by the defendants went to the Superior Court of Appeal (Tribunal Superior da relação -TSR), which should now decide whether to uphold the lower court’s decision or to rule for the appeal.

If the dispatch authorising trial is upheld, the case will be tried, but if the appeal is accepted, there would be room for a review of the [court’s] decision.

Accoring to the ‘Notícias’ report, the 20 co-defendants in case number 130/11/2019/PGR are charged with association for delinquency, blackmail, passive corruption, embezzlement, abuse of office or function, breach of management rules, falsification of documents, use of false documents, possession of prohibited weapons and money laundering, with modifications arising from evidence collected.

Nineteen of the twenty defendants are awaiting trial in prison, with only one having been granted bail.

The so-called undeclared debts were contracted, with state guarantees, by the companies Proindicus, Ematum and MAM.
