Mozambique criminalises unauthorised photographic, video or audio recording

The recording of words spoken by someone but not intended for the public and the filming or photographing of a citizen against his/her will, even if at a public event or venue, is now punishable with imprisonment and a fine under the Penal Code recently revised by Mozambique’s Assembly of the Republic (parliament).

“It is punished with imprisonment up to 1 year and corresponding fine, he who: records words spoken by another person and not intended for the public, even if addressed to them; uses or allows such recordings to be used, even if lawfully produced,” the Penal Code revised by consensus of the three parliamentary benches last 26 July determines.

Also sanctioned with the same penalty are those who “photograph or film another person, even at an event in which he has legitimately participated; or uses or allows the use of the said photographs or films even if lawfully obtained.”

The revised Penal Code does, however, subject criminal action to a complaint. “Criminal prosecution depends on the offended party’s complaint.”
