The Moatize court has dismissed Renamo’s appeal against the municipal election results on the grounds that legal requirements had not been met, weekly newspaper Savana reports today.
According to Judge Ivete Canjale, among the missing legal requirements are a lack of legitimacy, lack of observation of legal deadlines and lack of any prior complaint to the District Elections Commission (CDE), with the respective decision by the same body.
Renamo says it has observed all the necessary legal requirements.
Analysts quoted by Savana says the Moatize court’s example will probably be followed and identical rulings are likely to come from the courts in other municipalities where the opposition has lodged judicial appeals. They also believe that the Constitutional Council will follow the same path.
Renamo spokesman Andre Magibire has accused Frelimo members in the Moatize STAE and CDE of having allegedly broken into the STAE warehouse in Moatize, taking the bagged votes and removing ballot papers, minutes and result sheets [‘editais’] which gave victory to Renamo.
In Moatize, the CDE held a full recount in which they rejected 1,400 Renamo votes, taking invalid votes to more than 7% of the total, the highest level in the country.
Magibire states that Renamo opposed the recount as well as to opening of the warehouse, and that, therefore, the CDE made the recount without the presence of Renamo. He says that on October 11, the day of the partial count by Moatize STAE, the results were as follows: Renamo 11,169, Frelimo 9,856. The minute was to be signed on the following day, October 12, he says.
However, Magibire said, Frelimo failed to appear for the signing, and, he claims, on the night of October 13 to 14, Frelimo members of the CDE broke into the warehouse, filled out a new result sheet and signed it, without the Renamo representatives present.
Renamo claims to have copies of all the result sheets, and says it will appeal to the Constitutional Court.
