The attorney general’s office in Mozambique has ordered an inquiry into the expulsion of Spanish activist Eva Anadon Moreno by the migration service in connection with her involvement in an illegal demonstration in Maputo.
The investigation was announced on Thursday by the attorney general’s office via a press release, and is to report within five days.
“Following the information provided on social networks and in the press, on the restoration of legality in the detention and expulsion of a foreign citizen via Maputo international airport, the Attorney General’s Office reports the following: In accordance with Article 236 of the Constitution and paragraphs b) and h) of paragraph 1 of Article 4 of Law No. 22/2007 of 1 August, it is the public prosecutor’s competence, among others, to enforce laws and control the legality of detention,” the statement said.
In this context, attorney general’s office notes that it had created lines of communication at provincial level and in the city of Maputo for citizens to report instances that may constitute violations of the law by a public ministry.
“To exercise that supervisory role, public prosecutors have been assigned to meet citizens,” explains the statement, “provided that on March 29, 2016, in the jurisdiction of the City of Maputo, the magistrate for the prosecutor, in full exercise of her duties, was asked to intercede in an event taking place at Maputo International Airport, where a foreign citizen was allegedly detained to be deported from the country without having been notified in advance”.
The intervention of the magistrate to verify the detention’s legality “resulted from the failure to submit the order of detention and expulsion of the aforesaid citizen, whose contours must be ascertained”.
