The Attorney General’s Office (PGR) has established a commission of inquiry into the conduct of the Maputo police 11th Squadron Duty Officer and officials of the Immigration Department over the expulsion of Spanish citizen Eva Moreno after she participated in a demonstration over mandatory school uniforms.
The Attorney General says there is evidence of unlawful imprisonment, punishable under Article 484 of the Criminal Code.
According to Magazine Independente, the Attorney General says officials used force to prevent the execution of an order issued by a representative of the Public Prosecutor in the exercise of her duties, punishable under Article 489 of the criminal code.
A letter from the Attorney General quoted by Magazine Independente indicates that disciplinary procedures are justified, there being evidence of violation of a general duty to enforce the law and demonstrate exemplary behaviour as outlined in Law no. 16/2013 of 12 August (Law of Police of the Republic of Mozambique).
The PGR is also demandind the due inspection and control of legality in the implementation of the expulsion order by the Public Administration and the Attorney General’s Office, under paragraph b) of Article 123 of the General Statutes of Employees and Agents of the State (EGFAE).
